Benelux is often filed as the easy part of a Northern European entry: English-speaking buyers, short decision paths, pragmatic culture. The outreach rules are not easy. They turn on a distinction most sales teams do not make: whether the message goes to a person or to a legal entity.

The Netherlands: consent, with one business exception

Article 11.7 of the Telecommunicatiewet prohibits unsolicited electronic messages for commercial purposes without prior consent, and the burden of proof sits with the sender. Since 2009 the prohibition covers legal persons, and since 1 July 2021 it protects users of an address, not only subscribers, which means a named employee's mailbox is protected whatever the legal form of the employer. The business exception is narrow: a company may be emailed at an address it has deliberately published for receiving such messages, and every message must carry a working opt-out. Telephone prospecting of legal persons remains permitted; consumers and sole traders require opt-in. The Autoriteit Consument & Markt enforces the rule and has imposed fines in the hundreds of thousands of euros.

Belgium: opt-in, with the impersonal-address exception

Article XII.13 of the Code de droit économique prohibits advertising by electronic mail without the prior, free, specific and informed consent of the recipient. A Royal Decree of 4 April 2003 provides two exceptions: existing customers, for the sender's own similar products with an opt-out; and legal persons, where the message is sent to an impersonal address such as info@ and concerns the activity of that legal person. A message to a named person at the company needs consent. The sender must be identifiable and every message must offer a way to object. The Data Protection Authority and the FPS Economy both handle complaints.

Why the distinction decides the program

In both countries the lawful email route leads to generic company addresses, which are rarely read by a decision-maker. The routes that reach the person are telephone to legal persons, professional networks within their own rules, introductions, events and post. A program that was designed for email will therefore underperform in Benelux unless it is rebuilt around the person, with the generic address used for what it is good for: a documented first contact that opens the door to a call.
